By providing your mobile phone number and expressly opting in through our website, forms, or other approved methods, you agree to receive SMS or MMS messages from Xplorer Lab related to your account, service updates, reminders, support communications, and, where applicable, other messages you have consented to receive.

Message and data rates may apply according to your mobile carrier plan.

Opt-Out

You may opt out of SMS communications at any time by replying STOP to any message. After you send STOP, you may receive one final message confirming your opt-out.

Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Xplorer Lab disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. We do not guarantee any specific business result, revenue increase, lead volume, cost savings, or performance outcome from use of the Services.

Limitation of Liability

To the fullest extent permitted by law, Xplorer Lab and its officers, employees, contractors, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, business opportunities, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to Xplorer Lab for the applicable Services during the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Xplorer Lab and its affiliates, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • your use of the Services;
  • your violation of these Terms;
  • your violation of applicable law;
  • your infringement of any third-party rights.

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved informally by contacting Xplorer Lab. If a dispute cannot be resolved informally, it shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction and venue of those courts.

We may update these Terms from time to time. If we make material changes, we will post the updated version on this page and update the "Last Updated" date above. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
